Code de Commerce de la Republic of Congo

The Congolese Commercial Code governs all commercial activities on national territory. ETS Mondésir is registered in accordance with the provisions relating to individual commercial establishments.

What this means for you: You are dealing with a legally recognised entity whose commercial obligations are defined and enforceable.

Regulation on Renewable Energies

La Republic of Congo développe son cadre réglementaire pour les énergies renouvelables. Nos installations respectent les normes techniques en vigueur, notamment les standards IEC (Commission Électrotechnique Internationale) adaptés au contexte africain.

Standards applied: IEC 60364 for low-voltage installations, IEC 61215 for crystalline solar panels, IEC 62109 for inverters.

What this means: Your installation is up to standard. In the event of an inspection or expert assessment, you have our installation certificate.

Congolese customs regulations

All our imports pass through official customs services. We scrupulously comply with:

  • The mandatory declaration of all imported goods
  • Payment of customs duties according to current CEMAC tariffs
  • Rules of origin and certifications required per product
  • The prohibition on importing counterfeit and dangerous goods

Important: Customs clearance times are beyond our control. In the event of a delay, we will inform you immediately with proof of filing.

OHADA (Organisation for the Harmonisation of Business Law in Africa) is a treaty signed by 17 African countries including Congo. It establishes a unified, clear and enforceable business law.

Incoterms define who bears the costs and risks of transport. We work primarily on CIF terms (Cost, Insurance, Freight to destination port) to maximise your protection. The term used is specified in each import quote.

The United Nations Convention on Contracts for the International Sale of Goods applies to our contracts with foreign suppliers. It precisely defines the rights of each party in the event of non-conformity or delay — and obliges us to make claims when necessary.

For significant transactions, we use payment mechanisms based on the Uniform Customs and Practice (UCP 600) and documentary collection rules. This protects the buyer (you) and the seller against respective defaults.

General Terms and Conditions of Sale

These terms apply to all our services. Written to be understood, not to be circumvented.

Article 1 — Acceptance and Scope

Any order placed with ETS Mondésir, by WhatsApp, email, online form or in person, constitutes acceptance of these T&C. These conditions take precedence over any customer document, unless a particular written and signed agreement has been made.

Article 2 — Prices, Quotes and Payment

2.1 Prices are in CFA Francs (FCFA), firm for 15 days from the date of the quote.

2.2 Deposit: For any service exceeding 100,000 FCFA, a deposit of 40 to 60% is required at the time of order. The balance is due on delivery or completion of the service.

2.3 Payment methods: Bank transfer, Mobile Money (MTN, Airtel), cash, bank cheque. ETS Mondésir never requires full upfront payment for a first order.

2.4 Invoicing: A receipt or invoice is issued for every transaction. Keep it in case of dispute.

Article 3 — Delivery and Deadlines

3.1 Indicative lead times:

  • Local catalogue products: 24 to 72h within Brazzaville
  • International import: 3 to 8 weeks depending on the country of origin
  • Solar installations: schedule communicated upon confirmation

3.2 Force majeure: ETS Mondésir is not responsible for delays caused by customs, third-party carriers, strikes or force majeure. We commit to informing you within 24h of any foreseeable delay.

3.3 Transfer of risk: Risk is transferred to the client upon actual delivery. For imports, upon handover to the carrier at the port of departure, unless cargo insurance has been taken out.

Article 4 — Warranties and Returns

4.1 Product warranty: Manufacturer warranty per product specification + ETS Mondésir conformity warranty (product matching the quote, free from apparent defects).

4.2 Installation warranty: Labour warranted for 6 months. Installation defect identified within this period = free repair.

4.3 Returns: Report within 7 days. Product in original condition. Return costs at our expense if the product is defective or non-conforming.

4.4 Exclusions: Misuse, unauthorised modification, force majeure.

Article 5 — Liability and Disputes

The liability of ETS Mondésir is limited to the amount of the service concerned, except in cases of gross or intentional misconduct duly established.

Disputes: Amicable resolution as a priority within 30 days. Failing that, mediation at the Brazzaville Chamber of Commerce. Failing that, competent courts of Brazzaville. Applicable law: Congolese law supplemented by the OHADA Uniform Acts.
